The E.E. Decision Sheds Light on Notaries Acting as 'Courts' and on a Few Other Notions Within the Context of the Succession Regulation

Under Succession Regulation the term ‘court’ takes a broad meaning. In addition to any judicial authority, all other authorities, and legal professionals with competence in matters of succession, which exercise judicial functions may also be considered as courts under certain conditions. The preliminary ruling of the CJEU in the case of E.E. (C-80/19) sheds additional light on the cases, in which notaries exercise their competences in succession proceedings.
